Privacy policy

This policy explains what personal data I collect, what I use it for and what rights you have, in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD).

2. What data I process

Only the data you give me when you get in touch or hire me:

  • Your name and, if you provide it, the name of your business.
  • Your phone or WhatsApp number and email address.
  • The content of the message you send me.
  • If we end up working together: the data needed for the proposal, the contract and invoicing.

3. What I use it for

  • To reply to enquiries that arrive through the contact form or WhatsApp.
  • To manage the commercial and contractual relationship: proposals, projects, support and invoicing.
  • To comply with my legal obligations (tax, accounting).

4. Legal basis

  • Consent, when you submit the contact form or write to me on WhatsApp.
  • Performance of a contract, when you hire a service or request a proposal.
  • Legal obligation, to keep invoices and tax documentation.
  • Legitimate interest, to maintain reasonable communications with clients about the services they have contracted.

5. Who can access your data

I do not sell or share data with third parties for commercial purposes. Only the providers needed to deliver the service are involved:

  • Web3Forms: processes the contact form submission and forwards it to me by email.
  • Google (Gmail): the email provider where I receive and answer messages.
  • Own hosting in the European Union for the website and the software I develop.

When a provider processes data outside the European Economic Area, it does so with the safeguards provided for in the GDPR (standard contractual clauses or adequacy decisions).

6. How long I keep it

  • Enquiries that do not lead to a contract: 12 months from the last contact.
  • Clients: for as long as the relationship lasts and, afterwards, for the periods required by law (4 years for tax purposes and 6 years for accounting records).

7. Your rights

You can exercise your rights of access, rectification, erasure, objection, restriction of processing and portability at any time by writing totechbastiann@gmail.com, stating which right you wish to exercise. I will reply within one month at most.

If you believe the processing does not comply with the law, you can lodge a complaint with the Spanish Data Protection Authority (Agencia Española de Protección de Datos):www.aepd.es.

8. Minors

This site and its services are aimed at businesses and professionals. No data is knowingly collected from anyone under the age of 14. If I find that a minor has provided data, I will delete it.

9. Security

I apply reasonable technical and organisational measures to protect data: encrypted communications (TLS), access control, backups and limiting access to information to what is strictly necessary.

10. When I build software for your business

If you hire a tool that stores data about your own customers (appointments, quotes, documents, contacts), you remain the controller of that data and TechBastian acts as adata processor. In that case we sign a data processing agreement in accordance with Article 28 of the GDPR, which sets out what data is processed, for what purpose, where it is hosted (European Union), what security measures apply and what happens to the data when the service ends.

I may update this policy to adapt it to legal or service changes. The date of the last update appears at the top of the page.
